Funeral Home Pays $32,000 to Settle FTC Charges

The owners of a Brooklyn, New York funeral home have settled a FTC civil penalty lawsuit alleging that they violated key provisions of the FTC Funeral Rule giving the consumers the right to buy only the funeral goods and services they want or needed. The FTC alleges the funeral home informed consumers on at least two occasions that they would not conduct funeral services for them unless the consumers purchased a casket from the funeral home. The funeral rule prohibits funeral homes from requiring consumers to buy any item, including a casket, as a condition of obtaining any other funeral good or service. The FTC is authorized to obtain civil penalties of up to $16,000 for each Funeral Rule violation. (Memorial Business Journal June 28, 2012)
